Have you signed up for your free stuff today? Or just
wanted to buy something lately and had to put your first
name and email in? Or just wanted to see what information
is on a site and filled one out? I do not know how many
lists I am on now, I lost count. It is good marketing
practice to get as many subscribers as you can and have a
big list, but is this getting out of hand?

As a marketer is feel that I must look at other sites and
see what is out there. I dedicate a half hour a day and
sometimes a little longer looking at my co-marketers sites
and also like to look at the sites with top rankings on the
search engines. I am finding a lot more sites are not
letting me view them without opting in, you know, landing
pages, or squeeze pages. I do understand the principle and
the reasoning behind this, I am a marketer also.

The other side of this is I have dedicated a half hour of
my day to read my email. I have 4 email addresses now.
One personal that I check frequently, one for business, one
for subscriptions that I like to read up on and am glad I
joined and another for forced sign ups.

It has gotten to the point that I would need to dedicate my
whole day to reading email if I read them all. I know
about the unsubscribe link at the bottom. It just seems
like a waist of my time to have to open each one and go to
the bottom, press on the link and then to the next and so
on. I opened my forced email today that had been unopened
for 3 days and had over 350 emails I had to delete just to
empty it.

My point is that I am looking at this differently now.
Rather than a good practice, how many people are doing the
same with my emails? People getting overwhelmed with email
and even though they might want to read what I have to say
or offer, they see hundreds of emails and just delete the
whole box.

I admit that a lot of the fault is my own because I am a
buyer. I love to keep up with the latest and see the
products and test them and use them. I am a good consumer.
Some people I buy from every time they come out with a new
product. I also like reading the email copy and ad copy to
get ideas and educate myself on copy.

It has been said that each one on your list is worth $1. I
feel that I am a little more valuable to some, am less
value to most others.

I am teetering on the top of the fence right now with the
list building tactics and logic. I am seeing it as a
necessity and also as being like a used car salesman. I
think it could hurt a lot of good marketers with good
information to offer. I don't believe that they will not
survive because if you have good products and good services
then you will get return business, and they also will have
affiliates working for them. It is going to get very hard
for the little start up marketers though.

The value of the list is going to be dropping like the
value of the dollar and real estate. There is going to be
too many people with large lists and not enough consumers.
My thoughts are that marketers are going to have to be more
focused on SEO, Adwords, articles, social sites, forums,
banner ads and links to get people to their sites. The
email response is going to become a minimal factor. I
could be wrong, but that is my forecast after looking at my
email box today and deleting it all without even glancing
at but a few headlines.

I don't recommend anyone else doing this, but I am going to
live like I always have, by the golden rule. I am not
forcing anyone to join my subscription. If they like my
freebies and like my content, and chose to receive
information from me, then they can sign up.

likely to write your own marketing copy. Be aware that this
is a highly regulated area that could result in substantial
liability. I've boiled most of the regulations into 2
basic traps you must avoid.

What is Marketing Copy?

Wikipedia defines "copy" as written material, in contrast
to photographs or other elements of layout, in a large
number of contexts, including magazines, advertising, and
book publishing. In advertising, web marketing and similar
fields, copy refers to the output of copyrighters, who are
employed to write material which encourages consumers to
buy goods or services.

Web copy has one major advantage over offline copy - it is
interactive. Hyperlinks provide you with powerful tools to
lead a potential customer through a pathway designed by you
which ultimately leads to a conversion to your call to
action.

Trap No. 1: Failure To Substantiate Claims Before
Publication

When you write your own marketing copy, you necessarily
make certain "claims" - statements upon which a consumer
may reasonably rely in making a purchase decision. In so
doing, you're facing another legal pitfall.

Legally, claims are extremely important. The Federal Trade
Commission (FTC) Act, 15 USC Sec. 41-58 and accompanying
regulations prohibit "unfair or deceptive acts or
practices". Unfair or deceptive acts or practices include
claims that are not substantiated before the claim is
publicly disseminated.

So review your ads carefully, and be sure that you can
substantiate and back up your ad claims.

Here are some examples of claims and the related challenges
regarding substantiation and back-up:

* If you claim "best value", understand that it's a
promise that is very broad in scope - essentially, you're
promising that your offer is worth more than the asking
price - if you're going to make this claim, you'd better
provide the proof on your site.

* If you claim "we're no. 1", you need to be very specific
regarding how you determine no. 1 - no. 1 at what? - in
gross sales, in sales growth for a specific period, in the
number of widgets sold?

* If you claim the "latest and greatest", "next
generation" or words to that effect, you should
substantiate how the claim is true - explain specifically
how you justify the claim in relation to other competitive
products on the market.

* If you claim "user friendly" or "easy-to-use", you need
to be specific regarding substantiation of specifically how
much time a certain task routinely takes, exactly which
steps are automated.

* If you offer a "risk-free guarantee", understand that
even a free evaluation is not completely risk-free because
the evaluation takes time for the customer to evaluate -
time is money, so-to-speak, so a better approach is to
promise an unconditional refund, no questions asked.

Trap No. 2: Avoid Untrue And Deceptive Claims

In addition to substantiating claims before making them, be
careful not to make untrue or deceptive claims. Certain
types of claims should be avoided altogether, including:

* never claim that you have a cure for anything - not even
large drug companies with products that have been the
subject of years of testing will make such a claim, so you
shouldn't either;

* never specify a level of revenue or profits that a user
will achieve, even if you or another purchaser has achieved
a specific level of revenue or profits - remember the old
cliche, "your mileage may vary";

* never promise specific results - again "your mileage may
vary".

The FTC has special rules governing any use of the term
"FREE" (or similar words to that effect), which the FTC
believes is frequently used in an untrue or deceptive way.

Similar words to "free" include:

* Buy 1-Get 1 Free; * 2 for 1 Sale; and * 50% off
with the purchase of 2.

According to the FTC: "[t]he public understands that,
except in the case of introductory offers in connection
with the sale of a product or service, an offer of 'Free'
merchandise or service is based upon a regular price for
the merchandise or service which must be purchased by
consumers in order to avail themselves of that which is
represented to be 'Free'. In other words, when the
purchaser is told that an article is 'Free' to him if
another article is purchased, the word 'Free' indicates
that he is paying nothing for that article and no more than
the regular price for the other. Thus, a purchaser has a
right to believe that the merchant will not directly and
immediately recover, in whole or in part, the cost of the
free merchandise or service by marking up the price of the
article which must be purchased, by the substitution of
inferior merchandise or service, or otherwise."

Conclusion

In summary, be aware that what you say in your marketing
copy is heavily regulated. You need to be careful not only
to substantiate ad claims before you post them to your
site, but also use certain key terms with great care so as
not to mislead or deceive consumers.

The whole point of an opt-in list is that your prospect has
given you permission to send them information on your
company and products. This effectively means you have been
invited by the prospect to tell them about your products as
they have already expressed an interest in what you have to
offer. Therefore you cannot be accused of spam mail.

Newsletters are a great way to keep contact with your list
and provide useful and informative information to your
prospects. They also encourage your list to visit your site
regularly and check for new content. As we all know content
is king, if your prospects like your content then you are
already more then half way to converting them to customers.
Newsletters are also a great way to build your list.

The most effective and easiest way to contact your list via
email is through the use of an autoresponder. There are
many on the market today, most internet businesses use
Aweber as do I and I recommend it.

You can set up your autoresponder to send messages to your
prospects that have enquired about your products, its very
simple to do. Your objective here is to appeal to your
prospects emotions as we all know that when making a
decision to purchase it is usually driven by emotion first
and then justified by logic later.

I would recommend if you are new to internet businesses and
to email follow-up messages then you get an experienced
sales copy professional to help you compose these messages.
It is well known that a prospect needs to be contacted at
least 7 times before they will buy - so follow-up is key
and the easiest way is through using your autoresponder.

Typically, most internet businesses try and get their
prospects to buy something that is relatively cheap, lets
say under $40. For most prospects this should not be a
problem. Once the prospect has bought from you they become
your customer and are now very valuable to you.

They have proved they are willing to get their credit card
out and purchase from you. This differentiates them from
prospects in a real way - You can now try and up sell your
customers higher ticket items. This is where most internet
companies make most of their money so you can see how
important it is to know who your customers are and what
they are interested in purchasing.

Once your list has grown you can make extra money not only
by selling your own products and services but by using the
following methods, obviously the larger your list the more
money you can make:

a) Create and maintain affiliations with other companies
that are involved in the same industry or sector as
yourself. These other companies provide links on their
products and services that you can add onto your site or
newsletter. Every click made on the affiliates link will
mean money for you.

b) Again by establishing affiliate deals you can ask for a
percentage of sales made by your list purchasing products
from your affiliates. Once a member on your list clicks
through to the affiliates website and purchases goods, this
is recorded and you get a percentage of the value of the
purchase.

c) Sell advertising space. Many companies will be prepared
to pay for banners and other similar adverts on your
newsletters or even your website. The amount you can charge
will vary on the size of the advert and how many unique
users visit your website or how big your opt-in list is. I
would strongly advise against selling or renting out your
list - it will damage your reputation with your customers
and lead to a long term loss in sales and will result in a
shorter list.

d) You can sell information products in the form of e-books
or even articles that you have written. There is great
demand for information products on the internet, many
people are willing to pay to gain knowledge. With the trust
you created with your list, they will be much more likely
to buy from you than someone they have not dealt with.

e) Use your list to its full potential - get your list to
recommend you to their friends, family and business
associates. You could use recommend-a-friend and offer some
sort of free gift for doing so. An increase in your opt-in
list will pay handsome dividends now and in the future.

Remember your list is the life blood of your business -
look after it, take care of it, nurture it, make it grow
and it will reward you handsomely.

CAN-SPAM: "No Harm, No Foul" -- 4th Circuit Passes on Trivial Violations
The federal CAN-SPAM Act permits the sending of unsolicited
email advertisements under certain conditions. One
condition is that header information in the email should
not be "materially false or materially misleading". What
does this mean, and if you make a "technical" mistake in an
email header, are you strictly liable under CAN-SPAM?

The Vacation Spammer Case

In November, 2006, the 4th Circuit Court of Appeals
commented in the case of Omega World Travel v.
Mummagraphics, Inc.(sometimes referred to as the "Vacation
Spammer Case") that while Spam (unsolicited commercial
email) remains a vexing problem, the federal CAN-SPAM Act
"does not impose liability at the drop of a hat". This is a
good thing for email marketers.

The defendant, Omega World Travel, sent unsolicited emails
to plaintiff Mummagraphics advertising travel cruises. The
emails did not properly identify Omega's internet domain
and email address, but they did include an opt-out email
address. Mummagraphics' President did not use the opt-out
feature, but he did complain, even to the extent of posting
pictures of Omega's owners on anti-spam websites, which
prompted Omega to sue for defamation. Mummagraphics
counterclaimed for violations of the CAN-SPAM Act as well
as Oklahoma statutes.

The Court's Holdings

On appeal, the 4th Circuit held that (1) the Federal
CAN-SPAM Act preempts state law claims premised on
immaterial or "bare error," (2) certain technical
inaccuracies in the header information did not violate
CAN-SPAM's prohibition against "materially false or
materially misleading" header information, and (3) one
instance of not honoring an opt-out request within the
specific time did not constitute a "pattern or practice."

You may ask: why is the preemption of Oklahoma statutes
significant? The answer is that Oklahoma statutes imposed
less of a burden on Mummagraphics than CAN-SPAM.
Mummagraphics argued that all it had to show for a
violation of Oklahoma's statutes was mere "falsity" in
Omega's email headers, and not that the headers were
"materially false or materially misleading" as required by
CAN-SPAM. The court reasoned that to allow states to
prohibit immaterial error would undercut Congressional
intent as manifested in the CAN-SPAM Act, and for this
reason, federal preemption was appropriate.

Regarding the CAN-SPAM claims that Omega's email headers
were "materially false or materially misleading", the Court
found that the header information was not materially false
or misleading because the emails provided various methods
to identify, locate, or respond to the sender or
investigate an alleged violation of the CAN-SPAM Act.
Omega's emails provided its mailing address, a local phone
number and a toll-free number. Based on the various means
of identifying and locating the sender in Omega's emails,
the 4th circuit held that the alleged inaccuracies were not
material nor misleading.

Conclusion

What do you think; do you like the outcome of this case?
Your answer will depend on your point of view - - whether
you are a company engaged in email marketing, or an
anti-spam activist. Email marketers may draw some comfort
from not living under the constant threat of a lawsuit for
immaterial errors and trivial violations of CAN-SPAM. On
the other hand, anti-spam activists will view this case as
a major defeat.

Lengthy Sales Letters Full of Hype are a Big Turnoff
To a significant section of online users those huge sales
letters (sales pages) that go on forever are a BIG turnoff.
So are the ones full of hype. They lose their
creators/owners large sums of money

You know the ones I mean. They go on and on repeating
themselves with testimonial after testimonial. The ones
with hype typically show the front guy in swim wear
relaxing in front of his Hawaian beach property OR leaning
on his fabulous car(s) in the driveway with the mansion in
the background.

Am I the only one who feels like this? Is it just my age
group - the oldie newbie?

Does online marketing or sales pitch have to be so
different from offline marketing? And who writes this stuff
anyway? Top copywriters! What do they charge - $100 plus
per word?

I am associated with 2 programs - both with sales pages
full of verbiage and testimonials etc. Frankly, I had made
up my mind in the first couple of paragraphs. All I wanted
after that was the detail and the cost. I didn't want to
wade through another 1500 plus words of script, photographs
and garish colors.

Both are excellent programs. The one that has the most hype
does itself a real disservice. It's an excellent program,
whose main target (in my opinion) is the older generation
with a little extra cash. They should have researched that
a little better. These are the people who turn away the
most from hype.

Testimonials? Yes, I think they're great. But two will do.
If you want to offer more then how about a "click here for
more" button.

And forget the fancy cars, house and beach front property.
When I watch those I expect the next photo to be of the
front guy with an armful of fake Rolexes for sale.

This stuff insults the intelligence. The people who are
likely to be impressed are unlikely to be the people you
want in your business anyway.

This is internet pollution or have I got it wrong? Are
people really swayed by this sort of ad?

You see, here's the thing. I work a lot with the older
generation - the oldie newbie, the retiree. And many of
them get really put off by this stuff.

And here's another thing. They also get put off by web site
home pages that are full of flashing banners, information
overload, garish colors and HUGE LETTERING. I'm told that's
the equivalent of shouting

I get embarrassed sending my prospects to this type of home
page or sales page. I've decided to simplify my own (when I
learn how) because I feel uncomfortable with the way it is
now. So if I am wrong tell me now.

I understand that, with 50 million plus websites and who
knows how many sales pages, you have to do something to
stand out from the crowd. But does all that BS help? There
must be value in a simply stated, factual message with nice
clean lines. Easy to read and navigate.

Take a look at Google's home page. Now's that simple! And
it is the number 1 site in the world. Simplicity hasn't
held them back.

Sometimes I have been overwhelmed by some sites that I've
gone to. Got lost and couldn't even find my way back to the
message that drew me there in the first place.

You may think that the internet is a young person's medium
and that it doesn't matter what an oldie newbie thinks.
Well listen carefully.

Baby boomers make up the largest consumer group in the
world. Around the globe thousands of us are turning 60
every day. And we are the wealthiest consumer group in the
world.
