All too often, website owners are lax in nailing down
ownership and control of valuable domain names, and as a
result, are often required to litigate these issues costing
them thousands. The case of Dawson v. Brandsberg
illustrates these costly mistakes and how to avoid them.

Dawson v. Brandsberg - The Facts

The dispute was between a website operator and developer
regarding rights to a domain name that consists of the
operator's name: "robertedawson.com". Plaintiff Dawson and
his real estate firm (the website operator) hired Defendant
Brandsberg (the website developer) to develop a website. A
key fact is that there was no written agreement regarding
possession or use of the domain name.

Other important facts include:

* Plaintiffs requested Defendant to register the domain
name at issue;

* Defendant developed the website associated with the
domain name; and

* Plaintiffs paid for the initial registration of the
domain name, plus development, hosting, and maintenance
fees for the website.

Eventually, the business relationship soured, and the
Plaintiffs sought to transfer the domain name and the
website to another internet service provider. The Defendant
refused to transfer the domain name and the website, and
essentially held the domain name hostage.

Dawson v. Brandsberg - The Decision

Dawson brought suit against Brandsberg in the U.S. District
Court in Virginia under the Cyberpiracy Provisions of the
Lanham Act,Section 43 (d), 15 U.S.C. 1125(d). Dawson v.
Brandsberg, 2006 WL 2915234 (W.D. Va. Oct. 10, 2006).
Plaintiffs argued that the federal cyberpiracy prevention
statute was applicable, and that it protected the domain
name and imposed liability for a bad faith registration
with the intent to profit from the registration. Plaintiffs
also argued that it had a non-exclusive, implied license to
use the domain name, given that Plaintiffs had paid for
registration, development, hosting, and maintenance of the
website.

Defendant Blandsberg argued that:

* Plaintiff's name was not a proper trademark because it
was not distinctive at the time of registration of the
domain name,

* Defendant had registered the domain name and developed
the website with the intent to sell it to Plaintiff at a
later date, and

* Plaintiff had no copyright or implied license in the
website.

Defendant Blandsberg filed for a motion to dismiss most of
the counts of the suit. The Court ruled in favor of
Plaintiff Dawson denying the motion. The Court seemed to
rely heavily on Plaintiffs' arguments regarding the implied
license, stating "Even assuming that Brandsberg created the
website, if Plaintiffs have no license to use the website
or domain name, the creation would be valueless".

Conclusion: Lessons Learned

Don't rely on oral agreements; get it in writing! Provide
not only for ownership of the website, but also of the
domain name.

Provide that your domain name be registered in your name,
not in the name of the vendor.

Also, note that control over the domain name is very
important, and control goes with knowledge of the ID and
passwords to the domain

name account with the Registrar. So to maintain control, be
sure to change the password so that you are the only one
who has access to the administrative controls for your
domain name at your Registrar's site.

relocate to another area of the country? Or knowing that
your business has lost tons of money this month? What about
figuring out if you should change careers? These are the
types of problems that often bring us to a full stop. We
aren't sure what to do. What if we make the wrong decision?

Many of us agonize over our big problems for weeks, even
months at a time. We think through every single possibility
and outcome that could arise because of this problem. And
often times, that is all we ever do. We just think about
the problem. We don't do anything about it. We believe,

In other words, we give up. We feel that life has gotten

100 mph. Instead of standing up to our problem, we allow
our problem to knock us down. And after that, we can't get
up.

No matter how much we hide from our problems, they ALWAYS
find us. So, forget about running, hiding or
ignoring...these strategies never work. In fact, they only
make the problem worse.

The first step in solving a problem is to clearly define
the problem. We need to admit that we have this problem.
Believe it or not, most people don't even do this much!
People tend to use the "ignoring strategy" and it never,
ever works.

Second, you need to put yourself in control of your
problem. You cannot allow the problem to control you.
Researchers have found that whenever people feel that their
lives are beyond their control, their life satisfaction is
reduced by 40%. That means that you have no choice but to
use strategies that will solve your problems and put you
back in control of your life.

Third, you cannot allow your problem to consume and define
you. You are not your problem and your problem is only one
very small aspect of your life. This much is true. Many
people exaggerate their problems and begin to only see
their life in terms of their problem. Never make this
mistake...it will be detrimental to your happiness.

Scientists have found that happy people see problems as
temporary, solvable and isolated. Unhappy people view
problems as all-consuming and a definition of who they are.
Work very hard to see your problem realistically. Of course
your problem may be monumental. It may be a very difficult
problem to solve. But there are other aspects of your life.

In order to be truly happy, you will need to directly
address the problems in your life. And unfortunately, as
one problem disappears, another will surface. Such is the
nature of life.

We all must realize that problems are indeed a part of
life. Your life will never be problem-free. That is
impossible. Instead, you will need to accept the fact that
there will always be a problem to solve. Some of these
problems will be small, some will seem enormous.

Our goal is not to hope that problems will not come our
way. For problems will always be making their way to our
doorstep. Our goal is to learn how to react to our
problems. We need to understand that we are in charge of
how we will approach the problems in our lives.

How you decide to solve your problems is up to you. No one
else can do it for you. You can ignore the problem and
pretend that it's not there. You can run from the problem
and hope that it

doesn't catch up to you. Or you can hide from the problem
and hope that it doesn't find you. OR, you can take control
of your problem.

As a final thought, I want you to know that I truly believe
that there is a solution for every problem. The solution
may be difficult, but there is a solution. There is no
problem in our human lives that cannot be solved if we
dedicate our energy to the solving of it.

Nothing is impossible. If you believe that from the bottom
of your heart, then it will happen. You simply have to be
the driving force behind the solving of the problem.

Ultimately, the key to achieving your desired income
depends on the compensation plan of the company you are
involved in. Even though your income will get larger the
more you refer and the larger your organization grows, the
company just may be keeping most of it.

For example one distributor may be earning ten thousand per
month with ten thousand members in their organization and
another distributor could easily be making ten thousand per
month with two thousand distributors in their organization.
Now this is only an example, but as you can see the second
distributor has five times less the size of organization
and is making just as much. Yet another distributor may
need even less...how is this possible? They are in
different companies with different compensation plans. You
would not know which one is you unless you know the
compensation plan of your company.

All MLM companies are here to make money. The question is
how much are they willing to reward the distributors for
their hard work? Think of deciding which MLM company you
will work hard for the same as looking for a job. Would you
settle for ten dollars per hour instead of fifty dollars
per hour? I think not!

Over your course of network marketing you will come across
many companies. I can not go over each and every possible
compensation plan but I can give you some tips of things to
watch out for. Some companies are geared towards rewarding
heavy hitters, those who will sponsor many, and that is at
the expense of the part-time distributors. Other companies
are simply looking out for themselves, and they simply
won't reward members much at all. Lastly, there are a few
that have compiled very rewarding compensation plans
because they know that if their members are successful then
they will be too, and so they offer very generous pay
plans. Here are some things to consider:

1) Are there qualifications? If so, how hard are they to
achieve?

If there are a lot of qualifications in order to earn
income, or if these qualifications are hard to achieve then
this is the type of plan that hurts new marketers or
part-time distributors. It may be rewarding to heavy
hitters, but the majority of the people simply won't
qualify for that type of income. Is their breakage or
rollup that goes to the company if distributors don't
qualify? These types of rules only line the pockets of the
company or heavy hitters. Look for a plan that has few
qualifications that are easy for anyone who works the
business to achieve.

2) What is their percentage of payout?

This may not be easy to figure out in some cases, but if
you are able to get a good grip on the pay plan you can see
the numbers and find the percentage of revenue that the
company pays its distributors. Most will pay 40-50%. This
is not bad, but I would not say it is good either. This
type of percentage is fine for a side business that you
have added to your portfolio to create multiple streams of
income. For your primary business you want something that
will be more rewarding. If your company pays out 60-70%
that can help you make a decent income fast. If your
company pays out more than 70% then you've found a very
generous pay plan.

3) How big of an organization would it require to earn
$10,000 per month?

This one you can easily figure out by looking over your
compensation plan. This does not mean personal referrals,
but your whole organization. How many people need to be in
your organization in order to make 10,000 dollars each and
every month? The lower the number is generally better
because it could mean less work for more money. You can use
this as a general rule when creating comparisons. However,
you need to take a close look at your product and
membership fee to see if this is true for your company.

4) How quickly and easily can someone start making money
right away?

This will determine if your organization will be able to
keep growing and prevent people from dropping out. Once
people have a taste of money they are likely to get excited
and work harder. If your compensation plan is able to
reward new distributors for their accomplishments right
away by getting them into profit quickly they will continue
to build their organization. However, if they refer members
and get only a small return they will not be encouraged.

Someone has made money in any pay plan. This is because
money can be made in any pay plan if you know how to
effectively build each one. This discussion is not about
that, but the fact that not all pay plans are created
equal. On your search for the right MLM company the pay
plan is a crucial element to your success, because that is
where your money comes from.

I want to highly encourage you to take a close look at your
pay plan from an honest point of view. Is it fair? Is it
rewarding? Or do you need to promote yourself to something
better?

Millions of people join MLM and Networking Companies
everyday and do not understand the compensation plans.
There are millions more in networking companies right now
struggling and have no idea that they will never make any
money in the company they are in because the compensation
plan, most likely is impossible for them to have any
success.

My experience, when coaching others in this industry who
are building a good business as I am, ask the same question
about not understanding compensation plans. My question is
would you start a job without knowing how you are paid? Of
course you wouldn't. So why would network marketing be any
different? The thing is we really don't know how to look at
compensation plans and some of them are extremely
complicated. Here is a tip for you to figure out if the
compensation plan for the company that you are either with
or looking at is any good.

First, find out the minimum amount of product that you have
to order every month. Then determine how many people you
would need actively ordering within your entire team, every
month, to make the income that you want. It is that simple.
Let me explain. When you look at the number of people who
actively order your product every month, to make a residual
income of "X" amount of dollars, you can determine if it is
worth your time and money for your efforts.

Let's use ten thousand dollars as a reference point. How
many people do you need to make ten thousand dollars of
true residual income every month? I use ten thousand
dollars because it is a simple value to calculate.
Secondly, if you want to make twenty thousand, multiply by
two, if you want to make five thousand divide by two and if
you want to make a thousand, divide by ten. So ten thousand
dollars is a good way to determine if the compensation plan
for any company is good or not.

The sad thing about this industry though is when you
average out all the compensation plans of different
companies, you start to realize that in order for any
individual in network marketing to make ten thousand
dollars a month, they would have to build a team of about
twenty-five hundred people. That is, to make ten thousand
dollars per month of residual income, a distributor needs
about twenty-five hundred people actively ordering every
month! How is that likely to happen? It's not. This is the
reason most people fail in network marketing.

That is the sad part but here is the good news. Once you
start to look at compensation plans from this perspective,
you start to notice things. Like, if I need a thousand
people to start to make money, this is definitely not a
good opportunity. There are worst companies than that.
Other companies you need two thousand to make ten thousand
a month. I've seen companies where you can make ten
thousand a month with less than four hundred people.

So if you look at it from a part time person's perspective
and there is a company where they need twenty-five hundred
people to make ten thousand dollars, that would mean for a
part time person working one or two hours a night to make
only a thousand dollars of extra income, would have to have
a team of two hundred and fifty people actively ordering.
How likely is that to happen with a part time person? Not
too likely. But if you're in a company where you need less
than four hundred people to make ten thousand a month,
divide that by ten, now it means your part time person can
make a thousand of part time income with less than forty
people. Now that is a lot more doable for your part time
person than two hundred and fifty people.

So the way I look at it is what is your time worth? For
example, you are building a business in network marketing
and you have to build a team of twenty-five hundred people
to make ten thousand a month and, your next door neighbor
is in a company where she needs less than four hundred
people to make ten thousand a month. Well, you're both
putting in the same efforts in building your businesses but
maybe your making about five to ten dollars a hour compared
to your next door neighbor putting in the same amount of
effort, who is making two hundred or greater per hour. I
think your effort is worth two hundred dollars per hour. If
you don't agree, that's ok.

So when you start to look at compensation plans from this
perspective, you can literally determine if it is a good
opportunity or not. I hope this help those who are either

already in a network marketing company.

storm, I'm still a visual girl. For me, that means I'd
much rather read something than listen to it. If it's a
video of a software or service demo, I might be persuaded
to view that, if I have the time and if I have no other
choice. For the most part, I'd rather read about it. I
have tons of audio files stored on my hard drive, to most
of which I've never listened. They'll probably languish
away on my computer, only to be deleted one day when I've
forgotten why I downloaded them in the first place.

However, the ones I have "listened to" are the ones which
also offered a written PDF transcript. Okay, so it's
cheating a bit to say that I've "listened" to them, but
those files that came with transcripts got my attention
much more quickly than those without.

I realize that I'm in the minority here. The audio and
video methods of conveying information online are here to
stay, and the majority of Internet users like and prefer
those methods to reading. Studies also indicate that when
an online business owner adds audio or video to a site,
traffic and conversion rates increase dramatically.

The written word, however, is far from dead. I'm
discovering that there are more and more people who prefer
to learn by reading (or maybe we just attract one another).

still prefer to go to my office bookcase and pick up a
resource rather than search for my copy of the same
resources in my computer files. I've had my readers tell
me that they regularly print the PDF files they buy from me
and refer to them constantly. Perhaps your readers will do
the same?

3. Upsell New Products. Transcripts, unlike audio files,
offer the opportunity to upsell your reader to new products
or services. In the transcript, you can add several pages
that serve as a sales letter for a new product, or include
an order form that is similar to one that appears on your
site. You can easily update the offer in the future by
inserting new pages.

4. Immediate Gratification. If your reader is viewing the
electronic version of your transcript, she can immediately
click on the hyperlinks you include and see the sites to
which you refer in the teleclass. The mp3 listener, on the
other hand, may not have Internet access at the time she's
listening to the audio file, and consequently has to write
down the URLs mentioned and then view them when she's back
online. I've lost more slips of paper in this situation
than I care to remember, which is yet another reason that
having a transcript appeals to my learning style so much.

5. Second Profit Center. If you're selling the audio of a
teleclass or webinar, you can offer the transcript as an
add-on to the price of the teleclass for an additional fee.
I constantly see online entrepreneurs offering a teleclass
for $29 and then permitting the buyer to add a PDF
transcript for just $10 more. This method offers visitors
a choice and appeals to a wider variety of buyers than
offering only one option might.

Teleclasses and webinars are a profitable way to boost your
online business. Add transcripts to your offerings, and
see your profits increase even more!

Have you ever wondered exactly how many make money business
income opportunities there are on the internet today? I'll
give you a rough estimate! It is somewhere between 10,000
and infinity.

I say 10,000 because that would be way more opportunities
than I would ever care to look at. Of course infinity just
means that as I type this someone just added a new
opportunity to the total. It never really ends and that can
be a good thing or it can be a bad thing.

When you consider industries in general there are still
many different make money business income opportunities.
What I am talking about is industries such as, affiliate
marketing, network marketing, private label rights, home
businesses, and so on.

I'm kind of partial to affiliate marketing myself because I
like the idea of getting paid to sell other people's
products. I consider myself to be a fairly creative person
yet I have never created a physical affiliate product of my
own.

I have started various services including an article writer
business and hands off article marketing. I guess you could
consider this a product, but not an affiliate product
because there is no way for an affiliate marketer to make
money selling our service.

One way that I see many people creating income on the
Internet is to sell physical products on eBay. There are
many different ways to do this including selling affiliate
marketing products on eBay.

Blogging has become big business on the Internet and many
people have learned how to make money doing that. Some
people write for other bloggers and get paid to do. Yet
still others will blog for themselves and include products
for sale on their blog. Again and affiliate marketing works
excellent for this.

Here is something you have heard of, but have probably
never considered as a business opportunity. There are
people that stay at home and take paid surveys every day
and earn $500-$1000 a month doing it.

They make a business out of it by actually getting
organized and marketing themselves to companies looking for
people to participate in online discussion groups, and
opinion surveys. You will not get rich at this, but if your
goal is to quit your job or to just make additional income
at home $500 or more a month can really make a difference.

The number one thing that people go on the Internet to do
every day is to send e-mail. This creates an opportunity
for people who want to make money just doing e-mail
marketing. If you can master basic list building techniques
you can include affiliate marketing products in e-mails
that you sent to the list of people looking forward to
hearing from you.

There are people who earn a six figure income from home and
do nothing more than market to their e-mail list. This does

Have You Had A Defining Moment?
In an effort to assist you on your path to success, I have
been feeling the urge to let you in on a little secret -
one which every successful person has experienced. It is
what makes the difference between struggling to survive,
and moving forward to $1,000 a week or more. It is a
magical event where your whole world changes. It is a point
you can usually remember forever and look back on as the
day everything changed!

I used to get mad when I saw others succeed when I didn't.
I felt I worked just as hard, but success eluded me. I
spent the money on personal development and training, yet,
when it came time to roll out the rewards, somehow they
didn't come to me.

Sure, I was making a few hundred dollars a month from my
MLM business. At lest I made a profit, which was more than
most people. But, I wasn't getting any further. Some
invisible force blocked my path!

Then one day in June 200 it happened. Facing almost certain
bankruptcy, I had dragged myself down the freeway to Sydney
to attend yet another MLM meeting with some Guru who had
all the answers. After a couple of hours, it was obvious
that he didn't! Like everyone else, he wanted me to make
him rich - or at least that was the way I looked at it. I
mean the product was a web page builder - not very
exciting. It was very crude compared to what is on offer
today.

I left the meeting for the long trip home and whammo - I
was pulled over by a couple of kids in jeans who turned out
to be cops! They checked my license plate and discovered my
car was a day out of rego - bastards. I was hopping mad. I
had spent weeks getting the car ready and was going to get
the rego check done next day. There was nothing defective
about the vehicle. This was a technicality.

I reluctantly took the two tickets they presented and
started driving. They stopped me again. "Where are you
going?" "Home", I said. "You can't go anywhere or we will
arrest you!" I had to drive to the nearest Service Station
across the road and leave it till morning. I was not happy
- I was devastated. Don't you hate it when someone else
controls your life? When someone else tells you what you
can and cannot do, for no seemingly logical reason?

I waited. I rang my mum (she lived a few blocks away). "Can
I stay the night?" I pleaded. Then I thought about my
situation. Did I really want to spend even more of the
money I didn't have? I mean I was facing a huge dentist
bill, my business owed $30,000. Pretty soon the credit card
company would call for funds I didn't have. The TV stations
and Newspapers were circling in on me. The last thing I
needed was a huge bill for my car.

I did the only sensible thing. I climbed back in my car and
sneaked home! Got back around 2 am I think. I decided then
and there not to be pushed around by anyone. I decided I
would fight my way out of this and never go there again. I
decided I would do what it took to change my circumstances.
I decided that no human or circumstance would stop me!

Now, I had thought this many times and very little changed.
On those occasions I quickly slipped back to normality,
thinking that one day everything would be fine. This didn't
work! You may know what I am talking about?

In the next week, I got a job to provide some cash flow. It
came from nowhere. The car was registered. I wrote to the
cops and eventually they dropped the fines I couldn't pay.
I rang all my creditors and made arrangements to pay off
the debts. I started in another MLM that for two years
provided the funds I needed to pay off the debts.

Wind forward to June 2002. As I neared my goal of being
debt free except for the mortgage, a miracle happened. I
was laid off from my job. Yes, you guessed it, this
provided the rest of the money to get my finances back in
order.

This time I felt I was ready to start towards the big time.
I put an action plan in place and called my MLM team
members. I had picked out one company to become a success
with. Over the next few years, my income soared to some
$3000 or more monthly. Then I had some problems with up
line and company management and got disillusioned. I saw my
business slide. What was I to do?

I started marketing on the internet. I had been quietly
studying this for some time. First I had an on line course
adapted from workshops we used to conduct. Then I built a
system around a couple of the MLM products I had in my
arsenal. After a few months, one of them started climbing
in sales. Two years later, this single sales letter is
responsible for over $3,000 a month of my commission income!

Then I had a phone call from someone I met on a company
trip in Mexico or somewhere like that. I don't remember
him, but he remembered me. He, like many others, was
phoning everyone he had ever met to tell them about yet
another MLM! I told him to get lost - twice!

A few months later a friend of mine told me of spectacular
results with the products, so I rang back and joined. In
three months, I was earning $3,000 a month on top of what I
had before. This has continued and grown over the last year
or so. It ahs provided the additional funds for me to be
approaching $10,000 a month in commission only, and over
$20,000 a month in business turnover. Not bad for someone
who settled for a few hundred dollars once.

Like it or not, it was a decision made all those years ago
which started all of this success. I project a doubling of
business over the next year or so, and I have the plans to
achieve that. All three MLMs I am involved with are
growing, where thousands of others have quit or wondered
why they didn't work! My progress has been steady. It has
been consistent. Now I am so excited, I can't stop telling
people how great life is when you work for yourself, and
spend your efforts empowering others to move into a life of
freedom and passion. I have others in my group who feel as
I do. It all started with that one moment.

This industry is a great one. There are many success
stories. I bet if you asked those who are making it when
this started, they can tell you. It will be a moment when
they drew a line in the sand. A time when they decided the
buck stopped with them. A time when they decided they would
do what it takes to change their circumstances.

Like it or not, you have 100% control over your attitude. I
can teach you everything you need to succeed far better
than I have. It will only work if you have the right
attitude and determination never again to be controlled by
external thoughts, circumstances or people. Then you will
feel the power of the prophets, and of the great men and
women in history.
